Terms of Service

1. Acceptance of Terms

By accessing or using SnapSuited ("the Service"), you confirm that you are at least 13 years of age, that you have read and understood these Terms of Service, and that you agree to be bound by them.

If you are accepting these terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

These Terms of Service constitute a legally binding agreement between you and DGMA Limited, a company incorporated in Hong Kong, operator of SnapSuited ("the Company", "we", "us").

2. Service Description

SnapSuited provides an AI-powered professional headshot generation service. You upload between 1 and 3 photographs of yourself, and our service generates between 40 and 150 AI-produced professional-style headshot images.

Free trial: You may generate AI headshots at no cost. Free-tier output images include a visible watermark identifying them as AI-generated.

Paid plans: To download high-definition (HD) images without a watermark, a one-time payment is required. Paid plan tiers and pricing are published on our pricing page at snapsuited.com.

All output headshots are AI-generated images — stylised artistic representations, not real photographs. This is disclosed throughout the product experience.

3. Account Registration

To use SnapSuited, you must register an account using your email address. We use a magic link (passwordless) authentication system — a sign-in link will be sent to your email address.

You are responsible for maintaining the security of your email inbox and for all activity that occurs under your account. You must notify us immediately at support@snapsuited.com if you suspect unauthorised access to your account.

You may not create accounts on behalf of another person without their explicit consent, or create multiple accounts to circumvent usage limits or policies.

4. Acceptable Use

By using SnapSuited you agree to the following conditions:

• Upload only photographs of yourself, or photographs of another individual for whom you have obtained their explicit written consent to process their likeness through an AI system.
• Do not upload photographs of minors under the age of 13 under any circumstances.
• Do not upload photographs for the purpose of impersonating another person, creating deceptive identity materials, or facilitating fraud.
• Do not use the Service to generate content that is defamatory, harassing, obscene, or otherwise unlawful.
• Do not attempt to extract, copy, or reverse-engineer the underlying AI models or infrastructure.
• Do not use automated scripts, bots, or bulk upload mechanisms to abuse the Service.
• Do not share account credentials or resell access to the Service.

5. Free Trial and Paid Plans

SnapSuited offers the following plan structure:

• Free trial — available to all registered users at no cost. Generates a preview set of AI headshots with a visible watermark. No payment information is required.
• Starter Plan ($39 one-time) — HD download of a defined set of headshots without watermark.
• Professional Plan ($49 one-time) — HD download of an expanded set of headshots without watermark, with additional style options.
• Premium Plan ($69 one-time) — HD download of the full headshot set without watermark, including all available styles and backgrounds.

6. Payment

All payments are processed by Stripe, Inc. We accept major credit and debit cards, Apple Pay, Google Pay, and Stripe Link. We do not store your payment credentials.

Charges may be presented in USD, EUR, or GBP depending on your location and billing currency. Applicable taxes (including VAT where required) are calculated and displayed at checkout before you complete your purchase.

All paid plans are one-time purchases — there are no recurring subscription charges in Phase 0 of the Service.

7. Intellectual Property

Your uploaded selfie photographs remain your property. You retain all rights to those photographs.

The AI-generated headshots produced by SnapSuited are assigned to you upon download. You receive full commercial rights to use, share, and publish your generated headshots, including for professional profiles, marketing materials, and business purposes.

SnapSuited retains the right to use anonymised, aggregated, non-personally-identifiable data derived from usage of the Service to improve our AI models and service quality, unless you opt out by contacting support@snapsuited.com.

SnapSuited, its logo, and all original software, design elements, and brand assets are the intellectual property of the Company and may not be reproduced without written permission.

8. License Granted to Us

By uploading photographs to SnapSuited, you grant us a limited, non-exclusive, non-transferable, revocable licence to process those photographs solely for the purpose of generating your AI headshots and delivering the Service to you.

This licence expires when your source photographs are deleted (within 30 days of generation, as described in our Privacy Policy). We do not use your photographs for training AI models or for any purpose beyond service delivery.

9. Restrictions

You may not:

• Scrape, crawl, or systematically download content from SnapSuited.
• Reverse engineer, decompile, or attempt to extract source code or model weights from the Service.
• Use the Service in any manner that could damage, disable, or impair SnapSuited's infrastructure.
• Circumvent any access controls, rate limits, or security measures.
• Re-sell or sub-licence access to the Service.

10. Refund Policy

We offer a 14-day money-back guarantee on paid plans, subject to the conditions described in our Refund Policy at snapsuited.com/refund. Key condition: once you have downloaded your HD headshots, the refund is no longer available, as digital content has been delivered.

11. Termination

You may delete your account at any time via your account settings. Upon deletion, your generated headshots and account data will be removed in accordance with our data retention schedule.

We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, engage in fraudulent or abusive behaviour, or create risk or legal exposure for SnapSuited. In the event of termination for cause, no refund will be issued.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

AI headshot generation involves a degree of variability. While we work to deliver high-quality results, we cannot guarantee that every generated image will meet your specific expectations. Individual results vary based on the quality of input photographs, lighting, and other factors.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, SnapSuited's total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount you have paid to SnapSuited in the twelve (12) months preceding the event giving rise to the claim.

In no event shall SnapSuited be liable for any indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless SnapSuited and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any content you upload.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

For EU consumers, this clause does not affect statutory rights granted by EU consumer protection law in your country of residence.

16. Dispute Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at support@snapsuited.com to attempt to resolve any dispute informally. We will make a good-faith effort to resolve the matter within 30 days.

If you are an EU consumer, you are entitled to submit a complaint to the European Commission Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not currently registered with any alternative dispute resolution body, but we will cooperate with ODR processes.

17. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date and notify registered users by email where practicable.

Your continued use of the Service following the posting of updated Terms constitutes your acceptance of those changes.
