Read the data terms before you upload your face
This is the part of "free" that has no visible price and the largest downside. Training a headshot model means handing over a set of photographs of your face, which in several US states is legally distinct from handing over an ordinary photo. Illinois, Texas and Washington all have dedicated biometric statutes, and they work very differently from one another. Texas' CUBI requires notice and consent before capturing face geometry for a commercial purpose and carries civil penalties up to $25,000 per violation — but HB 149, the Texas Responsible Artificial Intelligence Governance Act signed in June 2025 and effective January 1, 2026, added a carve-out for biometric data used to develop, train, evaluate or offer AI models, which falls away only if the system is deployed to uniquely identify a specific person. Washington's statute is notice-and-consent with penalties up to $7,500 per violation. In other words: outside Illinois, the law is not going to be your remedy. The terms page is.

When Prisma Labs' "magic avatars" feature went viral at the end of 2022, Illinois users filed a BIPA class action alleging the app extracted facial geometry from uploaded selfies without the notice, consent and retention schedule the statute requires. Prisma's position was that it deleted biometric data within twenty-four hours of generating the avatars; the plaintiffs countered that a trained model can retain what it learned regardless of what happens to the source files. Versions of the privacy policy in force before mid-December 2022 stated that uploads were used to train the company's algorithms, and that language was changed in a later update. The litigation never produced a ruling on the merits — the California case was pushed into individual arbitration, and a parallel Illinois complaint was dismissed on pleading grounds with leave to amend.
